Agreement

By installing or using WhatchAlarm you agree to these terms. If you do not agree, delete the app. These terms are between you and the developer; Apple is not a party to them, though Apple’s own terms also apply to anything you buy through the App Store.

Licence

You are granted a personal, non-exclusive, non-transferable licence to use WhatchAlarm on devices you own or control, as permitted by the App Store Terms of Service. You may not resell, redistribute, reverse-engineer, or attempt to circumvent the purchase mechanism.

Free trial and purchase

WhatchAlarm is free to use for 14 days, counted from the day you first launch it. After that, a single one-time In-App Purchase unlocks the app permanently. You may buy at any point during the trial without waiting for it to end.

• This is a one-time purchase, not a subscription. Nothing renews and nothing is charged again.
• The unlock is tied to your Apple ID and can be restored on your devices at no extra cost.
• The trial is counted separately on the iPhone app and the Apple Watch app, so the two may differ by a day depending on when each was first opened.
• Prices are set per territory by Apple and may be adjusted automatically for local currency and tax.
• Refunds are handled by Apple, not by the developer. Request one at reportaproblem.apple.com.

Alarm reliability — please read

WhatchAlarm schedules its alarm on your Apple Watch and depends on hardware and system conditions outside the developer’s control. It can fail to wake you if, among other things:

• the watch battery runs down, or the watch is not worn overnight;
• a Focus mode, Do Not Disturb, Silent Mode, or Theater Mode suppresses the alert, including when WhatchAlarm has not been added to the allowed apps for Sleep Focus;
• notification permission was declined or later revoked;
• watchOS reclaims resources, updates itself, restarts, or otherwise interrupts the app;
• the alarm was not armed on the watch before you fell asleep.

Not a medical device

WhatchAlarm estimates sleep depth from heart-rate trends and wrist movement. That estimate is a convenience feature, not a clinical measurement, and it is not validated against sleep-laboratory methods. The app is not intended to diagnose, treat, cure, or prevent any disease or condition, and nothing it displays should be used to make a medical decision.

If you have concerns about your sleep, your heart, or your health, consult a qualified healthcare professional.

No warranty

WhatchAlarm is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The developer does not warrant that the app will be uninterrupted, error-free, or that it will wake you at any particular moment.

Limitation of liability

To the fullest extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, opportunities, earnings, or data, arising from your use of or inability to use WhatchAlarm — including any failure of the alarm to sound. Where liability cannot be excluded, it is limited to the amount you paid for the app.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Changes to the app and these terms

The app may change, and features may be added or removed, over time. Updated terms will be published at this address with a new effective date; continuing to use the app after that constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules, except where the mandatory consumer-protection law of your own country of residence grants you stronger rights.
